"TL;DR: Caveat Emptor, you may be charged and refunded 3 to 5 days later for a product that is impossible for them to deliver during which you may have to overcome various obstacles such as sending in a copy of the front and back of your Driver’s License and Credit Card as well as having extraneous charges placed on your Credit Card.

Placed an order on 1/7/2011 for a Lenovo T400 2765 Thinkpad Laptop and a Hitachi Travelstar 7K320 HTE23232L9A300 320GB Laptop HardDrive. Email confirmation from Cost Central/ Erie Computer Company (hereinafter “CC/ECC”) for Laptop states, in relevant part, "2 in stock as of 8:45pm 1/7/2011." With respect to Hitachi Travelstar the email confirmation stated to "allow approximately 2-3 weeks for delivery."
Called 3 days later (1/10/2011) to Confirm delivery date for T400 but despite the email and website stating they had two T400 Laptops in stock, the Customer Service representative told me that that this is no longer the case and requires at least 2 to 3 weeks for delivery of the laptop from manufacturer and that the Hard Drive is no longer sold by the manufacturer. Consequently, the order was modified to contain only the laptop.
Next day (1/11/2011), I was informed that they could not look up my phone number (it is unlisted because of the DO NOT CALL registry) to verify the address associated with the Credit Card and that it is necessary for me to send them a copy of the FRONT and BACK of both my Credit Card AND my Driver's License. Up to this point, this is quite possibly the most hassle I've ever experienced from an online retailer for a laptop that costs about $614 dollars and I've ordered various computer parts and laptops (totaling well excess of a thousand dollars per transaction) with the same credit card from other retailers without any hassle; many times, online retailers only require a Driver’s License number.
Despite this hassle, I sent the required information and CC/ECC promptly charged my Credit Card BEFORE verification of shipment or availability of the T400 laptop from Lenovo.
Two days later (1/13/2011) I was informed by CC/ECC customer service that Lenovo has discontinued production of the laptop and to "[p]lease allow 1-2 business days for the refund to reflect in our [sic] account."
In summary, not only was my Credit Card charged for 3 days without shipment from CC/ECC, I have also relied upon them, to my detriment, by not ordering any other laptop for the past 7 days. As a result, numerous sales on laptops (see for example www.slickdeals.net for Dell and Lenovo laptop sales within substantially similar price range) have already lapsed and I am still without a laptop. The Uniform Commercial Code (UCC), codified and adopted in almost all states, has long recognized this type of injury to buyers when the seller failed to perform his duty (e.g. deliver) under contract and buyer has to effectuate cover i.e. buy a substantially similar product at most likely a higher price. For example, UCC 2-712(2) provides “[t]he buyer may recover from the seller as damages the difference between the cost of cover and the contract price together with any incidental or consequential damages as hereinafter defined (Section 2-715), but less expenses saved in consequence of the seller's breach.”
In addition, I still have a pending charge of $1.00 in my Credit Card from CC/ECC even though the entire order has been cancelled by them. Given the numerous listings of items that have delivery from manufacturer on CC/ECC’s website, it makes you wonder how many items are no longer manufactured and thus, how many customers have fallen into the same trap like me and ended up with pending charges on their Credit Cards for days without delivery of any product or have relied upon CC/ECC to their detriment in delivering the product.
