"GameVE had, at the time of my order, falsely advertised MSI's PCI-E X800XT (non-Platinum) graphics card as "[PCI EXPRESS] MSI RADEON X800 XT 256MB PLATINUM RETAIL." They had also stated in the product description that it had 1100 MHz memory speed. In fact, it is not a Platinum Edition graphics card and it does not have that memory clock; I have confirmed this using MSI's website and through speaking with representatives of MSI.
To this date, MSI has never produced a PCI-E Platinum Edition graphics card (nor has any other manufacturer, according to an MSI representative). They have only ever produced this type for the AGP interface. The MSI X800XT-PE graphics card for AGP was the product that I intended to buy.
Remember that, as I was browsing the GameVE website, I was assuming that the product descriptions provided were correct. Typically retailers exert some effort to ensure that this is the case. Apparently, GameVE doesn’t, being “just the middle man” (according to a customer service representative). I was also armed with the knowledge that MSI did not produce a PCI-E Platinum Edition card. Therefore, when I saw the words "[PCI EXPRESS] MSI RADEON X800 XT 256MB PLATINUM RETAIL," the words “MSI” and “PLATINUM” really jumped out at me. Since there is only one graphics card in the universe--namely, the one I wanted to buy!--to which these words could apply, I ordered this one, disregarding the rest of the product description as irrelevant. I did not know at the time that I was going to be fooled into ordering the wrong product through deceptive labeling, so I did not take special care to prevent it from happening.
This is the story that I have given to GameVE in conjunction with my request that they waive the 15% restocking fee, since the mistake was caused by a deception on their part, intentional or otherwise. That I could have noticed the “[PCI-EXPRESS]” warning on the product description and investigated further is irrelevant—I did not, and if GameVE had not falsely advertised this product in the first place, there would never have been a problem. I have never, in any of my communications with GameVE, accepted responsibility for this mistake. I maintain that the blame lies squarely with them. It is the responsibility of the seller (be it GameVE, me, or anyone else) to resolve problems caused by deceptive product labeling. This is the case whether a company sees itself as the “middle man” or not—if you cannot take responsibility for your own mistakes and rectify them, then you have no right to be doing business.
GameVE did not accept these arguments. I was told that I would be granted the privilege of paying GameVE ~$40 instead of ~$85 so that they would be able to make a profit from their mistake. God forbid that a large distributor should be expected to lose a small amount of money in order to make good with a customer. I told them that this was not acceptable and to cancel the RMA for the time being; I would try to sell the card myself.
That didn’t work, so I applied for another RMA a few days later. I tried approaching the issue from a slightly new angle. If a company falsely advertises a product and a customer buys it, he is entitled to receive a full refund—regardless of his reasons for ordering it. This is more than an accepted guideline among businesses—it’s the law! Unfortunately GameVE were not able to understand even this simple and obviously valid argument. What they did understand, however, was that they were in possession of $500+ of my money, and, by God, I wasn’t getting any of it back whether what I said made sense or not! Why? No clue. Perhaps, they are, as my mom (apparently) accused them of being, **’s—whatever one of those is.
So, long story short—err, long—I decided to take it in the ** from GameVE and give them their (admittedly lowered) 8% restocking fee. Bottom line, GameVE apparently don’t care about providing customer satisfaction or behaving ethically—they care about getting your money through any means possible. If you order a $5000 plasma TV and they send you a floppy disk drive, I guess you’ll have to take a $400 restocking fee on top of the return shipping costs if you want to see a refund. Buy from Newegg.com instead…
[P.S. The product to be returned was left at my mother’s house in another part of the state last weekend to be shipped back to GameVE when the time came. She necessarily knows all about this and is justifiably angry. Your allegations that I asked her to call you are false. If she did so, she did it over her own free will. I cannot be held responsible for the unsanctioned actions of other adults.]
