Another representative called me back to address my situation. He offered to honor the manufacturer's warranty and refund the difference in price between the retail and contractor versions of the thermostats. While it shouldn't have come to this, and I never should have had to deal with any of it, I am happy with the final resolution. Thank you for following up.

I ordered two of the Nest 3rd Gen Learning Thermostat Stainless Steel, Model#: T3007ES on 7/25/16 (said they were in stock online). I was notified a couple days later that they were back-ordered until 9/2/16! I then received notification on 7/29/16 that they shipped--they were delivered today 8/9/16 (8 days later). However, when I opened the box, there were two of the contractor/pro version, Model#: T3008US. I wouldn't care, but it says clearly, in several places, "Not for retail sale" and "Sale without professional installation is strictly prohibited and will void the Nest warranty." I called customer service and was basically called a liar by the agent (she said I could have changed my order confirmation email to say "3007ES" vs. "3008US")--unbelievable! Her "solution" was to waive the re-stocking fee, but that I would be responsible for shipping the units back. They send the wrong thing, call me a liar, and then ask me to pay shipping to remedy their error (with no offer to send me what I actually ordered). I wish I could give less than 1 star--avoid like the plague!"

As with all orders we sent email confirmation which contained billing, shipping, and order information. In the email it states that if you like to make any changes or notice any errors to please call us over the phone. We did not receive any emails nor phone calls from you until August 1, 2016 at which point that order had already been shipped as of July 28, 2016. While we do sympathize with the exuberant shipping cost however we do state that orders cannot be changed once shipped. Again we strongly apologize, but unfortunately there is nothing we can do regarding the situation. We are truly sorry and we thank you for your purchase and hope you’ll choose us again in the future.
