"UPDATE as of 2/20/07. Buy.com has approved my claim and is issuing a refund for the item. Took over 60 days but in the end they agreed to issue refund. Still will avoid this problem in the future with Buy.com by not buying from them again.
Wont honor claims on items that were mis delivered by FedEx. FedEx has a legal agreement with them that Buy.com/Ingram Micro has to file all claims. On Dec 20,06 my packages were delivered to another address but not mine. I was home and they never came by the whole day. Since I monitor online tracking on all my packages I found out at 2:11pm that FedEx stated it was delivered. I called Buy.com within 40 minutes of this and stated the fact they were mis delivered and they took a claim. They then came back instantly and said that since FedEx showed it delivered to my address or not it was now my responsibility for the item. They then told and emailed me the following in exact words:
Per company policy: "Title to goods passes to you upon delivery to the
common carrier." (http://www.buy.com/corp/legal.asp). Basically this
says that once a product is in transit via the shipping carrier, the
ownership and responsibility of the product has passed from Buy.com to
the customer. It is the customer's responsibility from this point
forward to make sure someone is at the delivery address provided to
accept the package. If no one is available at this address at the time
of delivery, the carrier is authorized to leave the package at the door
and the order is considered completed at that time.
We apologize for the inconvenience and do appreciate your business at
Buy.com.
I was told point blank that even if the package is delivered elsewhere and not to the addressed label on package its my responsibility to be at that location to accept the package. If no one is home they have instructed FedEx to just leave the package. FedEx has admitted that it was mis delivered and their hands are tied due to this claim processing agreement. Buy.com says they are no longer responsible to make sure I receive an item once the shipper picks it up. Sounds like a nice way to avoid any claims now or in the future with this bogus agreement they have.
BEWARE OF THEM.. It wont matter if they deliver it to your house or one 600 miles away as long as the
tracking shows it delivered to ANYONE its now your loss and responsibility. They wont take responsibility to make sure packages are delivered to the correct people and FedEx has tried to help all they can.Even if damages in transit it becomes your responsibility and not FedEx and especially not Buy.com. Avoid having this problem by not ordering from them. Mistakes happen and I made a big one buying from them.
Customer service is hrs on the phone waiting and no questions get answered at all. No supervisors available whenever you call"
"This Company is GOING OUT OF BUSINESS !!!
Do not order here, period!
I have been waiting since Oct 31, 2006 for a refund (as well as another one from Dec 7) and have not received either. Been on hold for 2 hours now wiating for a service rep to answer (I guess India is celebrating their Chinese New Year), and I have been all through the email chain back and forth.
I even tried to go through my credit card company for re-imbursement of the charges, which Buy.Com fought for and had my credit card company deny, and then respond to me in their latest email that they cannot refund the charges because of a chargeback (which was denied, and I have the paperwork).
This company has sunk so far, so fast, watch the doors close. If I were you, I would not order ANYTHING as who knows when they will disappear!

"this is the WORST online retailer that i have ever dealt with. i ordered 2 blue tooth headsets on the 12th and customer service will not help me with where my package is. my average hold time over 3 calls is 39 minutes. this store is AWFUL"
"buy.com is a pain in the ass. i ordered a printer and i cancelled it on the same day.
after 2 weeks, the cancellation was still in process. so i finally decided to write an e-mail to their customer support. they said the shipment was on its way! i was mad, i cancelled this two weeks ago and they totally ignored it. they had two weeks to cancel the order. so i ended up losing 30 bux and had a uselss printer thats sitting in my garage"
"My Experience with Buy.com
On February 11th, around 2:00am I was browsing Buy.com looking for Digital SLR Cameras. I stumbled upon the Samsung Digimax GX-1S for $339.99 with free shipping usually shipping out in 1-2 days. Of course I jumped on the deal with this camera being great for beginners and at a decent price, how could I not? I placed my order (32350522) at 2:22am and went to bed. On February 13, 2007, at 10:14am, I received an email from Buy.com confirming the cancelation of my order. However, I never authorized the cancelation of the order. At 12:14pm I received another email stating the purchase amount was refunded to me and the order was canceled.
After having arrived home from school, I called Buy.com at their online number (1-***-***-****). At approximately 5:00pm, on February 13th, 2007, I spoke with a general customer service representative. They were unable to assist me or give me any answers as to why my order had been canceled. I asked to speak to a manager and was placed on hold for 20 minutes. I hung up, and called the number back, getting to another customer service representative and asking to speak to a manager. I was placed on hold again, but a manager eventually took my call. I explained my situation to him; that I purchased the Item on February 11th, 2007 around 2:00am. The webpage said the Item was in stock and my order went through and I received all the confirmation notices by email. My bank account was also charged so they already had my money.
The manager I spoke to claims that when I placed the order, the webpage said that the item was out of stock, and was on backorder. If and when the item was to come in, then I would be shipped the camera. He also said he had a time stamped image of the page at the time of purchase that can back up what they are claiming. Little did they know however, that I had printed the page in its entirety, showing the price, and that it was indeed in stock when I made the purchase. Two and a half hours I made my purchase, the webpage still showed that it was in stock at that price.
I asked the manager if they would honor the price if they received more cameras in stock but he said no. So I then ended the phone call, and looked for a corporate number that I could call. I found a number for the California office ***-***-****) and spoke with a woman named Jamie. I explained my situation to her but she could not verify why the order was canceled either. I asked her if Buy.com would honor my price and match it by making up the difference from one of their marketplace retailers. She said they could not do this. She suggested that I call their supplier directly, Ingram Micro, and inquire as to why the order was canceled. I called Ingram Micro but they would not help me because I do not have an account with them, and I’m not a retailer.
I found that everyone at Buy.com, for the exception of Jamie, was very curt and rude. My simple questions were not answered and the customer service representatives did not what to deal with me. All I was asking is that they honor their price in whatever way is easiest for them. Even if that meant I had to order from another retailer. If they could make up the difference in the price, I’d be satisfied.
This was not a pleasant experience, and I will not be purchasing anything through Buy.com anytime in the future. I’ll be advising my friends and family to do the same.

"On 2-8-07 they had the Olevia 542I lcd tv for $959.99 with free shipping. It is now 2-14-07 and STILL the order hasn't been shipped nor do I know when it will. Originally the order was delayed because of the billing address not matching what was on my credit card. Thats a bunch of bull because it is on file! That same day I gave them the credit cards phone number to verify. The next day still no change. I emailed and called them to see whats going on. They said its because of the address issue! They act like they don't know how to pick up the phone to make a call to verify. The rep told me he is going to escalate my order to some other dept. Couple days later they finnally answered my email telling me they are still working on it.
Monday the 12th the order status was still unchanged. So I called them AGAIN. Btw, each call takes roughly an hr on hold before you get a rep. Emails take a couple days. Anyways, they finnally said the issue has been fixxed and the item will be shipped out no later than the 13th. Well today is the 14th and the order is still stuck in the processing stage! Can you believe that? Customer service is pretty much nonexistent at this place, all you get is the run-around and lies. Totally unacceptable! My credit card has shown a temp charge from day 1 so I feel theres no issue with the card. I'm beginning to think they just don't want to sell the set for that price. This will be my last order with them and hope others will avoid them like the plague. I know I will.
Update: Filed complaint with the bbb on the 14th. That got them moving and the tv shipped on the 16th and arrived on the 21st via mach1 air service. I feel the delay would have been much longer if I wasn't so persistant in getting them to move there feet. Anyways, the tv works great except for the fact that it has 8 bad pixels! I was going to keep it but changed my mind. So I called the folks at olevia and they are doing an advance replacement for me. They are very nice to deal with unlike the reps at buy.com. This is my 2nd olevia tv because of this. The replacement (and old one picked up) was delivered on 3-21 and appears to have 0 bad spots and works great."
"DO NOT USE BUY.COM! Their rebates are incorrectly dated and refused by the manufacturer (I bought a pair of Kingston 2GB flash drives).
I am also having big security issues and spam due to my purchase with buy.com. My credit card issuer is taking action, but buy.com will not even uphold their own privacy policy."
"was ordering a pack of DVD+R thru google checkout, somehow the transaction got stuck and tracked the order it says "data transmitted to fedex". was like that for quite a few days i decided to cancel the order. after a few email exchanges buy.com credited my money back.
the emails were sent by person not machine, i'd say that's good customer service."
"I used to be a fan of Buy.com but they have turned into pure crap recently. I ordered an instock item from them on the 17th. After two weeks they had not shipped. I cancelled, two weeks later they had not refunded. Now I'm using Paypal's dispute to try and get my money back from this sham of a company. Avoid at all costs."
"They have cancelled my order for a "limited quantity blowout" item without giving a reason, without e-mailing me, and so far the money hasn't been transferred back -- after it had already been sent to the warehouse.
I will never do business with them again. Either their inventory system is garbarge or they just make a habit of cancelling orders as a joke. I should've trusted their low rating on here and known better, but I gave them a shot.
Don't make the same mistake I did, they are a waste of time.
Update: Took them more than 10 days to refund my money to paypal, all the while only sending form letters about the whole cancellation and refund that were not informative. The cancellation email stated that I had requested the cancellation which is false, the refund email said, "We strive for your complete satisfaction. Therefore, we have refunded your order..." as if refunding my order for their cancellation was doing me a favor.
Thanks for nothing Buy.com!"
"Pros: 1) Could return wrong product. Cons: 1) They shipped wrong product, 2) took a week to get RMA, 3) promised to send correct product but took 14 full days from the time they acknowledged receiving the return in their warehouse to the time they issued a refund, 4) issued a refund instead of sending the correct product."
"Buy.com somehow failed to record the receipt of a returned product -- returned within their "14-day" guarantee. They have thrown up barrier after barrier to avoid having to make good on the guarantee. I would advise others to avoid making any purchase from Buy.com. Certainly, I will never do buy from them again."
"After i ordered an item on Buy.com i never got the tracking number just to find out after many phone calls and three weeks later that my order got lost. At that point i requested a refund just to get the order two weeks later and a refund refusal.I ordered in December and got it in February.Very poor customer service.Do not buy from buy.com!!!!!!!!!!!!!!!!!!"
"Ordered tax preparation software from buy.com on January 5. Instead of software, I received a printer cartridge. I returned the printer cartridge more than two weeks ago. Every time I send an e-mail or call "customer service" (actually customer non-service), I am told that the warehouse is running behind in processing returns. They won't even think about sending the correct item until they have processed my return. I am wondering if I will receive my tax preparation software before the deadline for filing my return."
"Never buy at buy.com. On January 18 a NAS was supposed to be delivered by FedEx to my apartment. The package was left in front of my door and was stolen. I called FedEx which replied that I should have the shipper make a claim and was told that it probably be covered. I contacted Buy.com and placed the claim. First claim rejected by Buy.com. I have called them at least 5 times, had to wait more than 45 minutes per call, and been rejected 3 times by Buy.com. The best part is there has been NO claims on the package with FedEx from the shipper. Buy.com is too lazy to even make a claim on the package. My opinion is take your money somewhere else."
